— S. 27(3) proviso (as amended in 2000) — Maharashtra Specified Cooperative Societies Election to Committees Rules, 1971 — R. 4 — Election of office-bearers of federal society — Eligibility of a member of a primary society to vote on its behalf in the election — Inclusion in provisional list of voters — S. 27(3) requiring that any new member of a federal society shall be eligible to vote only after completion of period of 3 years from the date of its investing any part of its fund in the share of such federal society — R. 4 requiring that person who completed a minimum period of 2 years as member from the date of his enrolment before 30th June of the year immediately preceding the year in which such election is due shall be included in provisional list — Appellant Society invested its fund in the share of the federal society (Respondent 2) and was also enrolled as a member of the federal society on 30-12-2002 — Election of office-bearers of the federal society was due to be held in April 2006 — Held, appellant became eligible to vote in the affairs of the federal society after 30-12-2005 i.e. when the election was due — Appellant also entitled to be included in provisional list — Eligibility of the primary society for inclusion of its name in provisional list under R. 4 need not be considered in the light of S. 27, (2006) 5 SCC 250
